These Terms of Service (“Terms”) apply to your access to and use of the websites, applications, and other products and services, including email services, training, events, marketing services, review, and message boards, and various other message communication applications (collectively, our “Services”) provided by Handy Kith, LLC. (“Handy Kith”, “we”, or “us”). By clicking to indicate your acceptance of these Terms, or otherwise accessing or using the Services, you agree to these Terms, and to use our Services in accordance with our Privacy Policy and Cookie Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, including the mandatory arbitration provision and class action waiver, do not access or use our Services.
In addition to these Terms, we may ask you to accept additional terms that apply to specific features, products, or services. To the extent any additional terms conflict with these Terms, the additional terms govern with respect to your access to or use of the applicable feature, product, or service.

Non-Disclosure Agreement
At any time during or subsequent to the contract period, the client agrees to keep in strictest confidence and trust all of the Handy Kith confidential information to which the client has access. The client will not use or disclose the Handy Kith confidential information without the written consent of Handy Kith.
The client agrees not to attack/criticize Handy Kith and any of its employees, associate or partner publicly (on public forums, blogs, social networks, etc) at any time during or subsequent to the contract period.
Governing Law and Jurisdiction
Governing law means which country’s rule of interpretation and legal remedies apply in case of any dispute arising out of the contract. Jurisdiction means the place where your dispute will be heard.
Any agreements or contracts shall be governed by the laws of the US and the parties submit to the exclusive jurisdiction of the courts of New York, USA in respect of any dispute or difference between the client and Handy Kith.
Any dispute or difference can also be resolved outside the court by appointing an independent third party (also known as arbitrator) on mutual agreement of the client and Handy Kith. However, in this case, the arbitrator’s decision is considered to be final and cannot be disputed or appealed in the court of law.
Disclaimers
The client acknowledges the following with respect to services from Handy Kith:
- All fees are non-refundable.
- Handy Kith makes no guarantee/warranty of project timeline or added expenses (like charging additional fees, etc.)
- The client guarantees any elements of text, graphics, photos, designs, trademarks, or other artwork provided to Handy Kith for inclusion on the website above are owned by Client, or that Client has received permission from the rightful owner(s) to use each of the elements and will hold harmless, protect, and defend Handy Kith and its subcontractors from any liability or suit arising from the use of such elements.
